1.- Information and purpose
The only personal data to which AUSA CENTER shall have access are those provided voluntarily by the User.
Along these lines, the User must be aware that to access some of the services offered through the Website, whistleblowing channel and social networks, he or she shall be asked for his or her personal data and to fill in forms with compulsory fields, whereby the omission of any of these may prevent us from being able to meet your request or limit you from being able to access or use the corresponding services and content, except when the data requested on the form is voluntarily.

Similarly, pursuant to the provisions of the data protection law, as well as Act 34/2002, of 11 July, on Information Society Services and Electronic Commerce (hereinafter, “LSSICE”), you are hereby informed that your data may be used to send you marketing and courtesy communications related to our company by telephone, post, fax, email or equivalent electronic means of communication.

Regarding the whistleblowing channel, the legal basis is Article 6.1c) of the GDPR for compliance with a legal obligation as established in Article 31 bis of the Penal Code, Circular of the Prosecutor's Office 1/2016 on Criminal Liability of Legal Entities, and Law 2/2023 on the protection of informants. Article 6.1 b) of the GDPR Execution of the contract in which the data subject is involved. Article 6.1 e) of the GDPR Public interest, in the event that the data controller proceeds to report or inform about a crime to the State Security Forces or to a Court, in preventing and acting against criminal offenses in accordance with Article 24 of the LO/3/2018, by reporting a possible crime.
2.- Consent

3.- Data Quality

4.- Date storage
AUSA CENTER shall store the personal data provided for the time necessary while the business relationship is maintained or the service is provided, and for commercial or marketing purposes, so long as the User does not state his or her will to oppose, erase or limit such data, if applicable.
In any case, in order to determine the data storage periods, the company shall take into consideration local laws, contractual obligations and the expectations and requirements of our customers. When you exercise your corresponding right of erasure, opposition or limitation, or when we deem that it is no longer necessary to process your data, we will proceed, where possible, to securely erase or destroy your data, unless a legal provision requires them to be stored, in which case we shall notify you and keep said data blocked.
Regarding the whistleblowing channel, the retention of personal data is as follows: In accordance with Law 2/2023 on the protection of informants and Article 24.2 of LO 3/2018, data will be kept for the time necessary to decide whether to initiate an investigation into the reported facts. In any case, after three (3) months from the introduction of the data, they will be deleted from the internal reporting system. If data retention is necessary to continue the investigation, they will be communicated to the AUSA body responsible for investigating the reported facts, who may continue processing them, without keeping a copy of the data in the internal reporting information system. Reports that have not been pursued will only be kept in anonymized form. Data will be retained for the time necessary to decide whether to initiate an investigation into the reported facts. If it is proven that the provided information or part of it is not accurate, it will be immediately deleted as soon as this circumstance is known, unless the lack of accuracy constitutes a criminal offense, in which case the information will be kept for the necessary time during the judicial proceedings. Reports that have not been pursued will only be kept in anonymized form and will not be subject to the blocking obligation provided for in Article 32 of LO 3/2018. In no case will the retention of internal communications and investigations exceed ten years. Once a judicial procedure is initiated as a result of the investigation based on information obtained from the whistleblowing channel, the retention period will be for the duration of the judicial procedure and the time necessary to address the company's responsibilities.
